WESTconsin Credit Union Account Disclosures

TERMS AND CONDITIONS

Dear Credit Union Member:

This disclosure contains the rules which govern, where appropriate, your account with us.

Unless it would be inconsistent to do so, words and phrases used in this disclosure should be construed so that the singular includes the plural and the plural includes the singular. The word "we" means the Credit Union and the word "you" means the account holder.

Please read this disclosure carefully; continued use of your account with us after receipt of this disclosure means you agree to these rules, you agree to pay the charges and fees listed, and you give us the right to collect the charges and fees, as earned, directly from the account balance. If you have any questions, please call us at the telephone number listed in this disclosure.

Much of our relationship with our members is regulated by state and federal laws, as well as our by-laws and amendments to by-laws, especially the law relating to negotiable instruments, the law regulating the methods of transferring property upon death and the rights of surviving spouses and dependents, and the law pertaining to state and other succession taxes, the law regarding electronic fund transfers, and the law regarding the availability of deposited funds. This body of law is too large and complex to be reproduced here.

The purpose of this disclosure is to: (1) summarize the rules applicable to the more common transactions, (2) establish rules to govern transactions or circumstances which the law does not regulate and, (3) establish rules for certain events or transactions which the law already regulates but permits variation by agreement.

We may permit some variations from these standard agreements, but any such variations must be agreed to in writing either on our account agreement card or in some other written form.

DEPOSITS. Any non-cash item deposited to this account (including items drawn "on us") will be given provisional credit only until collection of the item is final. We are not responsible for transactions initiated by mail or outside depository until we actually record them. All transactions received after our "daily cut-off time" on a business day we are open, or received on a day in which we are not open for business, will be treated and recorded as if initiated on the next following business day that we are open.

WITHDRAWALS. Unless clearly indicated to the contrary, any one of you who signs in the space designated for Signatures on the account agreement card may withdraw or transfer all or any part of the account balance at any time.

We reserve the right to refuse any withdrawal or transfer request which is attempted by any method not specifically permitted, which is greater in number than the frequency permitted, or which is for an amount less than any minimum withdrawal denomination. Even if we honor a non-conforming request, repeated abuse of the stated limitations (if any) may eventually force us to close your account. We will use the date a transaction is completed by us (as opposed to the date you initiate it) to apply the frequency limitations. Withdrawals will first be made from collected funds, and we may, unless prohibited by law or our policy set forth in this brochure, refuse any withdrawal request against uncollected funds even if our general practice is to the contrary.

We reserve the right to at any time require not less than a 7 day notice in writing before each withdrawal from a dividend-bearing account other than certificates.

LIABILITY. Each of you agrees, for yourself (and the person or entity you represent if you sign as a representative of another) to the terms of this account and the schedule of charges and fees that may be imposed. You authorize us to deduct these charges and fees directly from the account balance, including deposits made by, but not limited to Social Security, SSI, veterans benefits, and other exempt funds to cover overdrafts and NSF fees. We may charge for services you request which are not contemplated by this agreement. Each of you also agrees to be jointly and severally liable for any account deficit resulting from charges or overdrafts, whether caused by you or another authorized to withdraw from this account, together with the costs we incur to collect the deficit including, to the extent permitted by law, our reasonable attorneys' fees.

MEMBERSHIP RIGHTS. A credit union is owned and controlled by its members. Upon qualifying as a member, you have the right to save money, receive dividends on shares, borrow money, and vote at meetings. As a member, you are entitled to one vote no matter how many shares you own. Shares may be issued in the name of an individual or in a number of other ways (e.g. jointly, in trust, or in the name of a minor). Please refer to the back side of your account agreement card for a detailed description of the ways you may structure account ownership.
Keep in mind that a joint tenant, designated by a member, cannot vote, borrow money, or hold office, unless such tenant is within the field of membership and is also a qualified member. To effectively open a joint account, we require that all joint owners sign the account agreement card.

STOP PAYMENTS. To be effective, a stop payment order must be received in time to give us a reasonable opportunity to act on it, and must precisely identify the number, date and amount of the item, and the payee. We will honor a stop payment request by the person who signed the particular item and, by any other person, even though such other person did not sign the item, if such other person has an equal or greater right to withdraw from this account than the person who signed the item in question. A release of the stop payment request may be made only by the person who initiated the stop payment.

TELEPHONE TRANSFERS. A transfer of funds from one account to another account with us, by telephone, if otherwise permitted or arranged for, may be made by the same person and under the same conditions generally applicable to withdrawals made in writing. We restrict the number of transfers from a savings account to another account, or third parties, to a maximum of six per month (less the number of certain preauthorized transfers during the month). Other account transfer restrictions are shown elsewhere in this disclosure.

AMENDMENTS AND TERMINATION. We may amend any term of this disclosure, from time to time hereafter, upon giving reasonable notice to you. Reasonable notice may consist of posting notice of such changes in our building for a reasonable period of time, enclosing notice in the statement of this account, or separate notice by mail. We may also close this account at any time upon reasonable notice to you and tender the account balance personally or by mail. Notice from us to any one of you is notice to all of you.

STATEMENTS. If you do not notify us of an unauthorized signature or alteration within a reasonable time (not to exceed 30 days) after we send or make available to you your statement and items: (1) you cannot assert the unauthorized signature or alteration against us, even if we are unable to show a loss due to your failure and (2) you cannot assert any unauthorized signatures or alterations by the same wrongdoer on items paid by us after the reasonable time mentioned above elapses, but before we receive your notice. We lose these protections if we fail to exercise ordinary care in paying an item with an unauthorized signature or alteration unless you do not notify us of the problem within 30 days of when we send or make available to you the statement and items. You must also report any other account problem (e.g. erroneous statement, missing signature, unauthorized endorsement, etc.) within this 30-day period or lose your right to assert the problem against us.

DIRECT DEPOSITS. If, in connection with a direct deposit plan, we deposit any amount in this account which should have been returned to the Federal Government for any reason, you authorize us to deduct the amount of our liability to the Federal Government from this account or from any other account you have with us, without prior notice and at any time, except as prohibited by law. We may also use any other legal remedy to recover the amount of our liability.

GIFT CARDS. The following information applies to you once you become a member who has a gift card issued by WESTconsin Credit Union (WESTconsin). The following are your WESTconsin Visa Gift Card Terms and Conditions. In these Terms and Conditions "you" or "your" means the person who has received the WESTconsin Visa Gift Card; "we," "us," or "our," means WESTconsin Credit Union; "Card" means the WESTconsin Visa Gift Card. Please read the following carefully and keep for your records. Upon receipt, the Gift Card should be signed immediately. By accepting and using your Card, you are agreeing to these Terms and Conditions.

Gift Card Usage
Your WESTconsin Visa Gift Card is issued by WESTconsin Credit Union and may be used for purchases at most merchants where Visa Debit is accepted. The card may not be used at some merchants including airlines, recurring payments, non-financial money exchange establishments, hotels, gambling establishments, rental car agencies, or “pay at the pump” gasoline. (You may purchase gas by presenting the card inside to the attendant.) Some merchants, like restaurants, may attempt to submit authorizations against the card for an amount greater than the actual purchase amount. If a merchant attempts an authorization greater than the balance remaining on your gift card, it may be declined.

For Gift Cards purchased Online:
Before using your WESTconsin Visa Gift Card, you must activate it by calling the number on the sticker on your card from you home phone number, or by registering the card by clicking here.

For Gift Cards purchased in an WESTconsin office:
For information about your WESTconsin Visa Gift Card, you can register your card at  clicking here. You must sign the back before you can use your card.

This Gift Card is not a credit card. You may only use it when there is a balance remaining on the card and only up to the amount left on the card. Purchases will be deducted from you WESTconsin Visa Gift Card until the value reaches zero. If you are given value through the use of the Card greater than the balance remaining, you will pay us on demand the amount by which your transactions exceeded the balance remaining on the Card.

The WESTconsin Visa Gift Card is non-reloadable and cannot be reused. There will be a $2.50 monthly maintenance fee for each month there is a balance remaining on the card. This fee is waived for the first twelve months after the card activation date.

VISA purchases and cash advances, including ATM withdrawals, made in foreign countries or foreign currencies will be billed to you in U.S. dollars. The conversion rate to U.S. dollars will be determined in accordance with the operating regulations established by VISA. Currently the currency conversion rate used to determine the transaction amount in U.S. dollars is a rate selected by VISA from the range of rates available in wholesale currency markets for the applicable central processing date, which rate may vary from the rate VISA itself receives or the government mandated rate in effect for the applicable central processing date. In addition, VISA charges WESTconsin Credit Union a 1% International Service Assessment for each foreign country transaction, which will be passed through to the cardholder.

ELECTRONIC FUND TRANSFERS

The Electronic Fund Transfers we are capable of handling are indicated below, some of which may not apply to your account. Please read this disclosure carefully, because it tells you your rights and obligations for these transactions. You should keep this notice for future reference. Our business days are: Monday through Friday, excluding federal holidays.

Transfer Types and Limitations

Access Device Ownership. Any card or other device which we supply you to access your account is Credit Union property and must be returned to us, or to any person who is authorized to honor the card, immediately according to instructions. A card may be repossessed at any time at our sole discretion without demand or notice. You cannot transfer your card or other access device to another person.

Account access. You may be issued a personal identification number (PIN), for security reasons, and a card to access your accounts. Any PIN issued to you is confidential and should not be disclosed to third parties or recorded on or with your card. You agree not to disclose or otherwise make your PIN available to anyone not authorized to sign on your accounts. An access device (card and/or PIN) may be used to:

  • Withdraw cash from your Membership savings or checking account.
  • Make deposits to your Membership savings or checking account.
  • Make payments to your WESTconsin Credit Union loans.
  • Transfer funds between your Membership savings and checking accounts upon request.
  • Obtain balance information on your Membership savings or checking account.
  • Pay for purchases at places that have agreed to accept our access devices.
  • Pay bills directly from your checking account in the amounts and on the days you request.

Some of these services may not be available at all automated teller machines (ATMs).

Electronic Check Conversion. You may authorize a merchant or other payee to make a onetime electronic payment from your checking account using information from your check to:

  • Pay for purchases.
  • Pay bills.

Preauthorized Transfers. We are equipped to accept certain direct deposits to your Membership savings or checking account.

Limitations on Frequency of Transfers (Regulation D).

  • Preauthorized and telephone transfers made from any deposit account, except a checking account, to any other account of the depositor or to a third party are limited to a total of six per statement period. Three of those six may be third party transfers, for example an automatic insurance payment.
  • For security reasons, there are limits on the number of withdrawals you can make using ATMs.
  • ATMs or ATM operators may have other limits on the amount of withdrawals or deposits.

Limitations on Dollar Amounts of Transfers.

  • You may withdraw up to $250.00 from ATMs each day with an ATM or Debit card.
  • You may make an unlimited number of Debit card purchases each day up to a maximum of $2,000.00.

Charges for Electronic Fund Transfers

  • We do not charge for direct deposits to any type of account.
  • We do not charge for preauthorized withdrawals from any type of account.

Right to Documentation

Terminal Transfers. You will get a receipt at the time you make any transaction involving your account using an ATM or POS terminal, or any Debit card transaction with a participating merchant.

Direct Deposits. If you have arranged to have direct deposits made to your account at least once every 60 days from the same person or company, you may call us at the telephone number listed in this disclosure to find out whether or not the deposit has been made. If the only possible transfers to or from your account are direct deposits, you will get a quarterly statement from us.

Periodic Statements. You will get a monthly account statement from us unless there are no transfers in a particular month. In any case, you will get a statement at least quarterly.

STOP PAYMENT PROCEDURES AND NOTICE OF VARYING AMOUNTS

Right to Stop Payment and Procedure for Doing So. If you have told us in advance to make regular payments out of your account, you can stop any of these payments. Here is how:

Call or write us at the telephone number or address listed in this disclosure in time for us to receive your request three business days or more before the payment is scheduled to be made. If you call, we may also require you to put your request in writing and get it to us within 14 days after you call.

Notice of Varying Amounts. If these regular payments vary in amount, the person you are going to pay will tell you 10 days before each payment; when it will be made and how much it will be. (You may choose instead to get this notice only when the payment would differ by more than a certain amount from the previous payment, or when the amount would fall outside certain limits that you set.)

Liability for Failure to Stop Payment of Preauthorized Transfer. If you order us to stop one of these payments three business days or more before the transfer is scheduled, and we do not do so, we may be liable for your losses or damages.

OUR LIABILITY

Liability for Failure to Make Transfers. If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we may be liable for your losses or damages. However, there are some exceptions. We will NOT be liable, for instance:

  1. If, through no fault of ours, you do not have money in your account to make the transfer.
  2. If the transfer would go over the credit limit on your overdraft line.
  3. If the ATM where you are making the transfer does not have enough cash.
  4. If the ATM or system was not working properly and you knew about the breakdown when you started the transfer.
  5. If circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions we have taken.
  6. There may be other exceptions in our agreement with you.

ACCOUNT INFORMATION DISCLOSURE

We will disclose information to third parties about your account or the transfers you make:

  1. where it is necessary for completing transfers.
  2. in order to verify the existence and condition of your account for a third party, such as a credit bureau or merchant.
  3. in order to comply with government agency or court orders.
  4. if you give us written permission.

UNAUTHORIZED TRANSFERS

Tell us AT ONCE if you believe your card and/or personal identification number (PIN) has been lost or stolen or if someone has transferred or may transfer money from your account without your permission. Telephoning is the best way of keeping your possible losses down. If you tell us within two business days, you will not be liable for more than $50.00 for unauthorized electronic transfers to or from your account.

Also, if your statement shows transfers that you did not make, notify us at once. If you do not notify us within 30 days after the statement was mailed to you, you may not get back any money you lost after the 30 days if we can prove that we could have stopped someone from taking the money if you had told us in time.

If a good reason (such as a long trip or a hospital stay) kept you from notifying us, we may extend the time period.

ERROR RESOLUTION

In case of errors or questions about your electronic transfers, call or write us at the telephone number or address listed in this disclosure, as soon as you can, if you think your statement or receipts are wrong or if you need more information about a transfer listed on the statement or receipt. We must hear from you no later than 30 days after we sent the FIRST statement on which the problem or error appeared.

  1. Tell us your name and account number.
  2. Describe the electronic transfer you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information.
  3. Tell us the dollar amount of the suspected error.

If you tell us orally, we may require that you send us your complaint or question in writing within 10 business days.

We will tell you the results of our investigation within 10 business days (20 business days if the transfer involved a point of sale transaction or a foreign initiated transfer) after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days (90 days if the transfer involved a point of sale transaction or a foreign initiated transfer) to investigate your complaint or question. If we decide to do this, we will re-credit your account within 10 business days (20 business days if the transfer involved is to or from a new account) for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within 10 business days, we may not re-credit your account.

If we decide that there was no error, we will send you a written explanation within three business days after we finish our investigation. You may ask for copies of the documents that we used in our investigation.

FUNDS AVAILABILITY

Our policy is to make funds from your deposits available to you on the first business day after the day we receive your deposit. Electronic direct deposits will be available on the day we receive the deposit. Once the funds are available, you can withdraw them in cash and we will use them to pay checks that you have written.

Please remember that even after we have made funds available to you, and you have withdrawn the funds, you are still responsible for checks you deposit that are returned to us unpaid and for any other problems involving your deposit.

For determining the availability of your deposits, every day is a business day, except Saturdays, Sundays, and federal holidays. If you make a deposit before our lobby and drive-up close on a business day that we are open, we will consider that day to be the day of your deposit. However, if you make a deposit after our lobby and drive-up close or on a day we are not open, we will consider that the deposit was made on the next business day we are open.

LONGER DELAYS MAY APPLY

In some cases, we will not make all of the funds that you deposit by check available to you on the first business day after the day of your deposit. Depending on the type of check that you deposit, funds may not be available until the fifth business day after the day of your deposit. The first $100.00 of your deposits, however, will be available on the first business day after we receive your deposit.

If we are not going to make all the funds from your deposit available on the first business day after we receive your deposit, we will notify you at the time you make your deposit. We will also tell you when the funds will be available. If your deposit is not made directly to one of our employees, or if we decide to take this action after you have left the premises, we will mail you the notice by the day after we receive your deposit.

If you will need the funds from a deposit right away, you should ask us when the funds will be available.

In addition, funds you deposit by check may be delayed for a longer period under the following circumstances:

  • We believe a check you deposit will not be paid.
  • You deposit checks totaling more than $5,000.00 on any one day.
  • You redeposit a check that has been returned unpaid.
  • You have overdrawn your account repeatedly in the last six months.
  • There is an emergency, such as failure of communications or computer equipment.

We will notify you if we delay your ability to withdraw funds for any of these reasons, and we will tell you when the funds will be available. They will generally be available no later than the eleventh day after the day of your deposit.

SPECIAL RULES FOR NEW ACCOUNTS

If you are a new member, the following special rules will apply during the first 30 days your account is open.

Funds from electronic direct deposits into your account will be available on the day we receive the deposit. Funds from deposits of cash, wire transfers, and the first $5,000.00 of a day's total deposits of cashier's, certified, teller's, travelers, and federal, state and local government checks will be available on the first business day after the day of your deposit if the deposit meets certain conditions. For example, the checks must be payable to you (and you may have to use a special deposit slip). The excess over $5,000.00 will be available on the ninth business day after the day of your deposit. If your deposit of these checks (other than a U.S. Treasury check) is not made in person to one of our employees, the first $5,000.00 will not be available until the second business day after the day of your deposit.

Funds from all other check deposits will be available on the thirtieth business day after the day of your deposit.

DEPOSITS AT AUTOMATED TELLER MACHINES

Funds from any deposits (cash or checks) made at ATMs we do not own or operate may not be available until the fifth business day of your deposit.

ACCOUNT INFORMATION

By opening this account, you agree to be governed by the terms and conditions of this account as stated herein and as amended from time to time. We will provide you notice of any amendments as required by law. The following information applies to all accounts unless stated otherwise in the descriptions of specific accounts.

  1. Rate Information Current dividend rates and annual percentage yields (APY) are disclosed on a web page separate of this disclosure.
  2. Balance Computation Method Dividends are calculated by the daily balance method which applies a daily periodic rate to the principal in your account each day.
  3. Compounding and Crediting Dividends will be credited to your account and compounded monthly. The dividend period is a calendar month beginning on the first day of the month and continuing through the last day of the month. The dividend declaration date is the last day of the month. For example, the first dividend period is January 1 through January 31, with dividends declared on January 31. All following dividend periods continue this pattern.
  4. Nature of Dividends Dividends are paid from current income and available earnings after required transfers to reserves at the end of a dividend period.
  5. Accrual of Dividends Dividends will accrue on the business day you deposit non-cash items (e.g., checks) to your account.
  6. All dividends are paid into the account, unless otherwise mutually agreed.
  7. Unless dissolved, the Credit Union guarantees payment of dividends at rates so declared.
  8. National Credit Union Share Insurance Fund Member accounts in the Credit Union are federally insured by the National Credit Union Share Insurance Fund.
  9. Charges & Fees are listed in the Charge & Fee Schedule of this disclosure.
  10. All accounts at the credit union are non-transferable.
  11. We may collect all service charges and fees for an account first from that account, and then from any other account you may hold, if funds are not available from the first account.
  12. You will get a quarterly statement unless you have a checking account or line of credit loan, or have made ATM transactions in a particular month. Then, you will receive a monthly statement.
  13. Some fees may be reduced and may vary from month to month if a member or household maintains a qualifying balance with Membership Value Pricing (MVP). See a current MVP brochure for details.

ALL SAVINGS ACCOUNTS

  1. Transaction Limitations During any month, you may not make more than six withdrawals or transfers to another Credit Union account of yours or to a third party by means of a preauthorized or automatic transfer or telephonic order or instruction. No more than three of the six transfers may be made by check, draft, ATM or debit card, or similar order to a third party. If you exceed the transfer limitations set forth above in any statement period, your account will be subject to closure by the Credit Union. For more information, see the Regulation D section of this disclosure.

MEMBERSHIP ACCOUNT

  1. This account is required for Credit Union membership and access to other accounts and services.
  2. Minimum Balance Requirement $5.00 purchase of a Credit Union share. This account cannot drop below the required minimum balance unless all other accounts under this number have been closed.
  3. ATM/Debit cards can be used to access this account.

SAVINGS ACCOUNT

  1. No minimum balance requirement.

BUSINESS SAVINGS OR BUSINESS MONEY MARKET ACCOUNTS

  1. No minimum balance requirement.
  2. Transaction Charges You may deposit up to 50 checks per statement period without charge. Each check deposited over 50 per statement period is 5¢ per item.
  3. Business Money Market Account will earn same dividends as current Money Market Account.
  4. Service charges are listed in the CHARGE & FEE SCHEDULE of this disclosure.

CHRISTMAS CLUB ACCOUNT

  1. No minimum balance or deposit requirement.
  2. In the first week of November, the amount of the ending balance in your account will be transferred to your membership account.

FUNERAL TRUST ACCOUNT

  1. No minimum balance requirement.
  2. Some funeral trust agreements have maximum amounts the member may deposit, depending on whether or not the member receives Social Security Supplemental Income (SSI).

ALL CHECKING ACCOUNTS

  1. A statement period is from the 1st day of the month through the last day of the month.
  2. ATM/Debit cards may be used to access a checking account.

SELECT CHECKING ACCOUNT

  1. Minimum Balance Requirement You must maintain a minimum daily balance of $100.00 in your account to avoid a minimum balance charge. You are not required to maintain a minimum daily balance if you direct deposit your net pay, government, social security, or retirement payment, or are age 55 or older.
    If you are required to maintain a minimum daily balance and on any day during a monthly statement period, your account balance falls below the required minimum $100.00 daily balance, your account will be subject to a minimum balance charge of $5.00 for that month.
  2. No transaction limitations.
  3. Dividends Your account will earn dividends for each day that the account's balance is $500.00 or more.

PREFERRED CHECKING ACCOUNT

  1. Service Charges $6.00 per month. $4.00 per month if you direct deposit your net pay, government, social security, or retirement payment, or are age 55 or older. This account includes no charge travelers cheques and no charge money orders. If this account is closed, regular charges will apply to these items if you continue to use them.
  2. No minimum balance requirement.
  3. No transaction limitations.

BUSINESS CHECKING ACCOUNT

  1. No minimum balance requirement.
  2. Transaction Charges You may clear up to 50 checks per statement period without charge. Each check withdrawal over 50 per statement period is 20¢ per item. There is no limit for in-person withdrawals or preauthorized (insurance payment, etc.) transfers from this account. You may deposit up to 50 checks per statement period without charge. Each check deposited over 50 per statement period is 10¢ per item.
  3. Dividends Your account will earn dividends for each day that the account's balance is $500.00 or more.
  4. Service charges are listed in the CHARGE & FEE SCHEDULE of this disclosure.

FREE CHECKING

  1. No dividends are earned on this account.
  2. No service charges.
  3. No minimum balance requirement.
  4. No transaction limitations.

ATM (AUTOMATED TELLER MACHINE) CARD

  1. Card used with a PIN to access Membership savings and checking account.
  2. Service charges are listed in the CHARGE & FEE SCHEDULE of this disclosure.

DEBIT CARD

  1. Card used with a signature or a PIN to access Membership savings and checking account.
  2. Service charges are listed in the CHARGE & FEE SCHEDULE of this disclosure.

We also offer the following savings account options:

Certificates Certificate accounts offer a preferred rate in exchange for your commitment to leave funds on deposit for a set period of time. Early withdrawals are subject to a dividend penalty. We offer certificates with maturities of 3 to 60 months.

Individual Retirement Accounts (IRAs) IRAs are tax deferred investments for retirement. The investments are in a certificate. Special rates and other terms apply.

Money Market Accounts/Achieve Money Market Our money market account offers you premium rates and convenient withdrawal privileges, including the option of up to three withdrawals per month by check. See the Regulation D section of this disclosure.

Health Savings Accounts (HSAs) We offer tax-free accounts established to pay for future qualified medical expenses. The accounts are intended to assist those who have chosen a health insurance plan with a high deductible. See the Regulation D section of this disclosure.

We reserve the right to change terms in the Account Disclosure and to amend the terms under applicable law.

CHARGE & FEE SCHEDULE as of September 2007

Safe Deposit Box Replacement Key

Replacement of (1) lost key - $25. Replacement of (2) lost keys (lock drilling) - the greater of $100 or locksmith charge.
